# Telling drive-thru guests they are talking to AI: laws, chain practice and sample wording

Which laws touch AI disclosure, recording and voice data at the drive-thru, quoted with dates, what chains say, and sample greeting and sign wording.

A few state laws decide whether a drive-thru must tell guests an AI is taking the order. Maine requires a clear notice when a bot could pass for a person. Utah requires a truthful answer when a guest asks, and protects businesses that say it up front. Recording and voiceprint laws can need a notice of their own. The plain course is to say it in the greeting, show it on the board, and let "team member" reach a person at any point. This is not legal advice.

## Which laws touch AI disclosure at the drive-thru?

Each row quotes the law's own text. The last column is the question to put to your lawyer.

   Maine, 10 M.R.S. 1500-DD A person may not use a chatbot "in a manner that may mislead or deceive a reasonable consumer into believing that the consumer is engaging with a human being unless the consumer is notified in a clear and conspicuous manner".    Utah Code 13-75-103 A supplier using generative AI in a consumer transaction must disclose it "if the individual asks or otherwise prompts the supplier about whether artificial intelligence is being used". May 7, 2025 Does our AI answer "Am I talking to a robot?" truthfully every time?
  Utah Code 13-75-104 No enforcement action if the AI discloses "at the outset of any interaction" and "throughout the interaction" that it is AI, not human, or an AI assistant. May 7, 2025 Does a line on the confirmation board count as "throughout"?

  Illinois Biometric Information Privacy Act, section 15(b) Before collecting a "biometric identifier", which includes a voiceprint, a business must inform the person "in writing" and receive "a written release".    Texas, Bus. & Com. Code 503.001 Before capturing a voiceprint "for a commercial purpose", inform the person and receive consent. Since January 1, 2026, AI training is exempt "unless a system is used or deployed for the purpose of uniquely identifying a specific individual". April 1, 2009; AI exemption January 1, 2026 Does any part of the system recognize repeat guests by voice?

The Illinois wording is quoted from the Illinois Supreme Court's opinions in [Rosenbach v. Six Flags](https://www.illinoiscourts.gov/Resources/f71510f1-fb2a-43d8-ba14-292c8009dfd9/123186.pdf) (2019) and [Cothron v. White Castle](https://ilcourtsaudio.blob.core.windows.net/antilles-resources/resources/e304b011-82d9-4832-9cae-d8205749a2ec/Cothron%20v.%20White%20Castle%20System,%20Inc.,%202023%20IL%20128004.pdf) (2023). Texas's own AI law puts its notice duty on "a governmental agency" ([section 552.051](https://statutes.capitol.texas.gov/Docs/BC/htm/BC.552.htm)), and the federal recording law, [18 U.S.C. 2511(2)(d)](https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title18-section2511&num=0&edition=prelim), allows recording with one party's consent. Other states have their own recording and privacy laws, so check each state where you run a lane.

## What have chains said about AI at the lane?

- **McDonald's** says in its [U.S. privacy statement](https://www.mcdonalds.com/us/en-us/privacy.html), last updated July 1, 2026: "We may use audio and video captured in the drive thru to receive and process orders." It adds that it may use these recordings "to improve our technologies and operations".
- **Bojangles** gives its AI a name, Bo-Linda. Its [Bo-Linda page](https://www.bojangles.com/bo-linda/) calls it "a conversational cloud-based AI platform" and tells guests they can talk with it "just as you would with any of our team members". Its CIO told [Restaurant Business](https://www.restaurantbusinessonline.com/technology/bojangles-speeds-ahead-drive-thru-ai) in July 2024 that customers had said little about it, good or bad, and that friendliness scores had not changed.
- **Burger King** said in September 2026, as [Restaurant Business reported](https://www.restaurantbusinessonline.com/technology/burger-king-shifts-gears-drive-thru-ai), that some guests in its pilot restaurants drove off because they did not want to talk to a bot, and that it is building an easier way to order from a person. ## What could the greeting say?

These are our examples. Keep the AI line short, because every second at the speaker holds up the cars behind.

> "Welcome to [restaurant]. I'm the automated order assistant. Say 'team member' any time to talk to our crew. What can I get you?"

> "Welcome to [restaurant]. You're ordering with our automated assistant, and this order is recorded so we get it right. Say 'team member' for a person. What would you like?"

> "Bienvenido a [restaurante]. Soy el asistente automático de pedidos. Diga «persona» en cualquier momento para hablar con nuestro equipo."

## What could the sign and board say?

A sign reaches the guest before they speak, and the board stays in view for the whole order. This wording is our example:

## What should you ask your AI vendor?

1. Can we edit the greeting and the answer to "Are you a robot?" for each store and language?
2. Is lane audio recorded? For how long, where, and who can listen?
3. Is audio used to train your models, and can we opt out?
4. Does the system build voiceprints or recognize repeat guests by voice?
5. Which words hand the order to the crew, and can we add our own?
6. Can the confirmation board show a disclosure line, and who sets it?
